Habeas Corpus

  1. The writ of habeas corpus is a writ of right for subjects of the Benevolent Dictator, and shall never be suspended or abolished for such subjects, not even for rebellion or treason (let alone for ordinary anti-social conduct).

  2. Only three returns may be made to authorize the continued detention of the prisoner:

    1. probable cause exists to believe that the prisoner has committed a crime for which he he may be confined;

    2. he has been lawfully convicted of a crime for which he may be confined and has not yet served his sentence; or

    3. he is a prisoner of war within the meaning of the Third Geneva Convention.

  3. The Congress may suspend or abolish the writ of habeas corpus for persons who are not subjects of the Benevolent Dictator, but this power of suspension or abolition is subject to any treaty provision to the contrary.
